The question

Lisa was hired by YG Telecommunications Company (YG) as a District Sales Manager. She purchased a Honda Civic sedan under YG’s car plan benefit. However, due to reorganization, Lisa’s employment was terminated on the ground of redundancy. Consequently, YG ordered Lisa to pay the current market value of the Honda Civic, or surrender the same to the company for proper disposition. Lisa refused to do either, thereby prompting YG to file a suit for replevin before the Regional Trial Court. On the other hand, Lisa argued that the matter falls within the jurisdiction of the Labor Arbiter (LA). Does the LA have jurisdiction? Explain.

Held

The Labor Arbiter does not have jurisdiction over the replevin suit filed by YG Telecommunications Company against Lisa; jurisdiction properly lies with the Regional Trial Court, as the dispute is civil in nature and not a labor matter, in accordance with Rule V, Section 1 of the Issuances of the Department of Labor and Employment and its Attached Agencies and Smart Communications v. Astorga, G.R. No. 148132.

Explanation

The Labor Arbiter has original and exclusive jurisdiction over disputes that arise directly from the employer-employee relationship, such as termination disputes, claims for reinstatement, wages, and damages arising from employer-employee relations. However, this jurisdiction does not extend to civil actions that involve property rights or claims that are essentially civil in nature, even if the property or claim arose from an employment benefit.

A replevin action is a possessory civil action to recover personal property wrongfully detained by another. It focuses on the right of possession and ownership rather than employment terms or conditions. The Supreme Court in Smart Communications v. Astorga clarified that although a car plan benefit arises from the employer-employee relationship, a suit to recover the car or its value after employment termination is a civil dispute between debtor and creditor, not a labor dispute. Therefore, such cases fall under the jurisdiction of the regular courts, such as the Regional Trial Court, and not the Labor Arbiter.

Application to the facts

In this case, Lisa was employed by YG Telecommunications and availed of the car plan benefit, which is an employment benefit. However, after her employment was terminated due to redundancy, YG demanded payment of the current market value of the Honda Civic or its surrender. Lisa's refusal to comply led YG to file a replevin suit before the Regional Trial Court.

Since the dispute concerns the possession and ownership of the car, and YG's claim is for payment or surrender of the vehicle, the issue is essentially a civil matter involving debtor-creditor relations. It does not involve the terms and conditions of employment or a termination dispute that would fall within the Labor Arbiter's jurisdiction. The Labor Arbiter's jurisdiction is limited to labor disputes and does not extend to possessory actions like replevin. Hence, the Regional Trial Court correctly assumed jurisdiction over the case.
